Newby here with so many questions

This is my first post but I'm sure it wont be my last as I have so many questions. As a family we are going through a crisis in our lives and even if I don't get any answers it would be good to chat to others.

Question 1, Does anyone know if it is common practice to refer all cases of suspected domestic violence to the Crown Prosecution service?

Question 2. My brothers wife has left him and he had no idea it was going to happen. She cleaned out his bank accounts and left him virtually penniless. It has since come to light that for a coupe of years she has been transferring money from his account into hers using on line banking and there are a couple of transactions to a friend of hers. My brother has never liked this friend so there is no way he would ever agree to give her money and especially not in such large amounts. Does anyone know how he stands in law as he obviously has no proof he didn't give his wife permission to take the money.

It depends who is doing the referrals. In general, the police get involved if there is enough evidence to charge with 'domestic violence.' The prosecution can only convict if there is sufficient evidence. Suspected evidence may be sufficient on a police officer's 'reasonable belief' that a crime has been committed.

It's difficult where there is a marriage, as the police are likely to view it as civil matter, ie not criminal. I would say you need legal advice from a family law legal professional. In general, it could be theft or fraud...in practice, the police are not likely to want to get involved unless there's reasonable prospect of a conviction.
