  • Damage to car from car park.

    bit of a long shot but looking to see if a retail park could be liable for the damage sustained to my car I will attach some pictures below. long story short. There was some queuing traffic on a main road and it to avoid it. I went down a little road which is the entrance to a retail park and there was a very low hard to see traffic island that I went over and it has damaged two off my alloy wheels and tyres. ok maybe I should not have been so impatient but the island should be a bit more visible. any help would be appreciated.

    Huge longshot I think, if the land is owned by the retail park I can't see any obligation on them and you were not even a customer of the retail park so to pin liability on them is probably very unlikely.

    Then there is also contributory negligence that could be argued in which you agree that you have been impatient, decided to drive around the traffic to avoid delays resulting in you hitting the island and all fault rests with yourself. You can clearly see the size of the highway is fit for only single lane traffic and you tried to circumvent that.

    I am afraid it might not be the answer you want to hear but perhaps someone else may offer a different view.

      Rob is right on that one I'm afraid ...

      The long broken white lines on the road say hazard ahead IE merging traffic/junction/bend etc

      It could infarct be said that you were driving without due care and attention or dangerous driving as a pedestrian may have been crossing... I'd lay it to rest
