      hi nem, i'm back again, came home to some more presents from the lovely mr crabtree, any thoughts on this please? am i right in suspecting they're going to be ramping up project fear now and try to bully me into something? thanks for looking, look forward to your thoughts on this

          i was wondering, is it time to fire off cca request ref. loan, and now contact orange and see what they have to say ref the duplicate accounts that are in error?

            Yes very good idea, template in green box to of main forum page, use a postal order for £1 statutory fee mark it " For Statutory Fee Only". Send by signed for post.

              i will be typing up cca request tonight and sending tommorow, and then sit and wait for the reply. just the small matter of the orange debt now, i telephoned orange customer services on friday 19th aug, i gave the account number sent in lowell letters and my name and was told that the account is passed to lowell and nothing they can do for me. i explained my situation about having had 2 phones sent out for delivery, rejected one (as advised by orange staff member over telephone) and signed for one! got billed at home address for one handset and billed to delivery address (parents house) for the one that should of been cancelled, and that i had to get them to close this account and refund money. she got her manager to call me back, to which he said the account is closed deal with lowell, i informed him that they are not being helpful on the matter and thought he could give me the infomation i need, i have been informed that orange hold no info at all on this account, all their system has is, passed to lowell! no paperwork or financial statements whatsoever, i got him to confirm the address this account is registered to, he confirmed it to be my parents house (delivery address) i informed him no account should exist at that address and was told again, deal with lowell! i'm unsure now what to do with this, i feel my enquiry with them has not met with what i actual want from them? should i send a sar to orange or email a complaint high up? your or any other members advice would be greatly received

                If it were me, I'd SAR.

                Orange are now EE (Part of BT, I believe)

                    According to s77 CCA 1974 (If it were me, I'd include the bits in red as well)

                    77Duty to give information to debtor under fixed-sum credit agreement.

                    (1)
                    The creditor under a regulated agreement for fixed-sum credit, within the prescribed period after receiving a request in writing to that effect from the debtor and payment of a fee of [F1£1], shall give the debtor a copy of the executed agreement (if any) and of any other document referred to in it, together with a statement signed by or on behalf of the creditor showing, according to the information to which it is practicable for him to refer,—

                      hi guys, just an update, i sent the cca as above including the bits added by charity, a day after the 12 days was up, recieved a letter saying hsbc have been unable to supply all the documentation required to satisfy a cca request and they've decided not to pursue this debt at this time, however if the documents turn up at a later date they will be in touch. i was initially relieved to recieve this but after giving it more thought, is this just a standard letter because they have passed 12 days and are infact just waiting for it to appear? or is this genuinely that hsbc can't provide it? have you seen these scenarios before? any input would be greatly recieved , i'm yet to reply ref orange account, i have spoken to orange though and they say they have no paperwork, financial or terms and conditions and to speak to lowell? not sure to sar orange or just let lowell do the leg work yet?

                        Hi,

                        I think the only the tiniest chance of Lowell getting anything further would be a reconstituted copy of the HSBC agreement now.

                        I doubt that Orange will have much data ( a SAR is for " personal information only) as they don't take court action themselves and clear data on sold on accounts pretty quickly.

                          thanks for the reply nem, and for your guys advice through out! in terms of a recon agreement, would the original still be needed in court? i'm just trying to prepare for the worst, hope for the best!

                            If the agreement was pre April 2007 yes the original " should " be produced, but some have tried recons even in this situation with some small success I'm told.

                            Other wise a compliant recon and some evidence of use of a credit facility could persuade a judge that on the " balance of probabilities " a debt exists and is enforceable,
