  • Erudio - Capquest Student Loan Issues

    Good Grief I wish I had found this forum sooner :-(

    Can ANYONE assist with this issue PLEASE!!

    I have an old Mortgage Style Student Loan, Sold by the Government to Erudio, now in the hands of Capquest. My issue is this:
    • 1994-96 GNVQ Advanced Leisure & Tourism (failed)
    • 1996 Enrolled on a HND Leisure management course (did not attend as failed GNVQ, did not have the entry grades) and advised Birmingham College of this. Both Birmingham College and SLC have denied ever being informed that I would not be attending the course.
    • Receive a Student Grant (Loan??)
      • I have put a ? by the loan as I am pretty certain I received no funds directly by way of a 'Loan' and believe this money was paid directly to the college I enrolled at to take the HND
      • I acknowledge receipt of the grant and did try to make provisions to pay this back, but was advised by my local council that a grand did not need to be repaid.

    • I took advice from CAB, they advised that my best option would be to defer the loan until the issue was resolved. The issue went cold for many years, I initially did defer the loan, but after a few years stopped deferring, and subsequently the loan fell into arrears. SLC at some point also stopped sending deferment letters, but they in turn have refuted this and claim a deferment letter was sent every year ( a blatant lie).
    • SLC chased for a refund of the arrears on the 'loan' of which I refuted owing.
    • Because I had heard nothing about the loan until the loans were sold to Erudio, I did not bother to return to the CAB for many years.
    • When I heard of the sale of the loans I requested more assistance form the CAB, they informed me they did not keep records of the visits I had made previous regarding the SLC, and as some considerable time had passed they no longer had the paperwork I had provided them with (all original documentation pertaining to the issue).
    • I have informed Erudio that the 'loan' has always been disputed. Whilst the issue was in dispute they passed my details regarding the loan to Capquest to deal with. (are they allowed to do that?) This was a lengthy process to which now Erudio are refusing to acknowledge any more correspondence from me, stating that they have proof I received the loand and their last letter would be their final correspondence on the matter. (are they allowed to do that?)
    • I have agreed to pay Capquest £20pcm to clear the debt as I did not wish for this to escalate further and a claim for a CCJ be put in place. BUT, I still dispute owing the loan.
    • Birmingham College have advised they do not hold records back as far as 1996 and can not confirm whether or not I attended the course, they can see I enrolled, but not exams taken.
    • I have asked for confirmation of who held the funds for the loan. Erudio/ SLC maintain they have proof that I was given the loan and I banked the cheque, but have provided me no proof of this. I do not recall receiving a loan, and do not even recall who I banked with back in the 90's.


    Any assistance with this would be greatly appreciated.
