  • Safestyle UK decorating

Safestyle Uk have recently installed a door to the front of my house. During installation the builder made a large hole in the wall. He tried to cover this up using an un slightly plastic trim but the damage was too extensive for the trim to cover it. I have asked Safestyle UK to repair the damage to which they have refused to cover the decoration. They state the pre-contract information says they are not liable for redecoration.

Having spoken to Consumer direct and reviewed the Consumer Rights act 2015 I believe they are liable in that firstly they did not use reasonable care and skill to complete the work and more importantly the CRA 2015 states they cannot restrict their liability in relation to not having taken reasonable care and skill. I have exhausted all options including seeking redress from the Glass and Glazing Federation who explicitly state this is an acceptable practice. My letter to the GGF referenced the CRA 2015 yet their response oddly had no mention of this.

I'm left with either accepting they do the limited work and I redecorate or taking them to the small claims court for the cost of the work.

Can somebody tell me if its worth pursuing and if I'm right in my stance that Safestyle UK should return me to a position prior to the work being carried out. that being the hole repaired and decorated?

    Many thanks

    Chris

Have they filled or replastered the damage?

As yet no, they have offered to come and do the work but refused to do the painting part so I have said until we can find a final resolution then a half job is no good.

Would expect them to repair wall but not to repaint after all if its plastered you cannot paint it for a few days not normal for window companies to decorate if its excluded in their contract terms and conditions

I agree. If the hole was formed as result of a lack of skill and care then they ought to be responsible for the redec costs as well.

How much are you talking, a couple of m2.

As a compromise you supply the labour, let them pay for the paint and brushes. After all, the day you spend in court could be same time better spent painting your wall!

Without seeing the extent of the damage it is hard to comment, but if the work necessitated enlarging the opening, or breaking into the existing finish, IMO it would not be reasonable to expect the contract to
            include making good the decoration.
After all, if it was a papered wall that particular pattern may no longer be available. Would you expect the contractors to repaper the whole hallway?
As long as they make good the brick/block work and plaster up to a reasonable finish , I would think any court claim would fail.

              I agree with Des,
You have had a new door and frame installed. On removing the old frame. It sounds like some plaster has come loose.
Yes they should have filled and made good on finishing the work.
My best advice is to find your paint brushes.
              All the best,
              Peter
