    Hi guys

    I am new here and i want to say hi to everyone. I am hoping you can all help me.

    I had the most horrendous 2 1/2 years with peugoet, I had non stop faults and the moment i was able to Voluntary terminate, i did so back in Feb 16.
    I had to hand over my V5, which i signed and they signed. the garage assured me that they would send it off. As i've never done this before i suppose i was naive really. I never received an acknowledgement letter which apparently i should have received.

    I then received a tax letter a month ago and it told me to disregard if i was no longer the registered keeper of the vehicle so i did ignore it.

    today i have received a £100 penalty letter for not insuring my vehicle, which says that if i haven't got the acknowledgement from dvl a then i am still liable for the penalty.

    so do i question the garage and ask what the hell, have i even got any grounds to argue. i have read on net that even if i just pay the penalty, it shows that i am admitting that i am still the registered keeper of the vehicle and more penalties may come next year etc.

    i have no idea what to do!!!!!! PLEASE HELP

    Just to confirm you sent your V5C back by post and you didn't hold onto it?

    Assuming you sent it back to them then you are under no obligation to wait and receive an acknowledgment nor are you legally required to contact the DVLA to confirm it has been received. Of course you should do this really but if you don't not the end of the world because you are not obliged.

    The DVLA will try anything on you and technically they are giving incorrect factual law and so you could also challenge on that basis even though they are aware of the fact which they have attempted on a number of occasions in court to sue people but have failed so far.

    You might wish to take a read through this thread, which the DVLA dropped after threatening legal action and the poster was willing to defend the case.

    Just to clarify, can you provide us with a copy of the letter from the DVLA? Are you certain it says if you are not the registered keeper do nothing or does it say that you need to notify them?

    Once you have read the link above, I would suggest gathering as much evidence as you possibly can, including a statement if possible from the person who signed the V5C if you can remember which will help to boost your defence.
