I have received a particulars of claim for a County Court claim and am just completing the defence statement. Just one question can I off set charges incurred to recitify issues or do I have to issue a counter claim to the claimant

yoir best bet is to counterclaim with your defence. You put your defence then underneath that defence you put your counterclaim. If you do it that way then you do not have to pay any fees to counterclaim. If you only submit a defence then want to counterclaim you will have to pay the 255 court fees.If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. thank you. do I just complete a defence statement and on same piece of paper a counterclaim. Are there no fees for a counterclaim within a defence statement. That's why I thought to off set charges incurred not counterclaimComment

Entirely up to you if you want to put in your defence statement but I'd suggest a counterclaim - your defence is the defence to their claim as the counterclaim will be seen as an offset against theirs if the judge agrees. Also means they will have to submit a defence against your counterclaim otherwise if they fail to do so then you can obtain judgment against them for that sum of moneyIf you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need.
