    Hi all,

    I need some advice please.........

    Long story short......

    I built up a sizeable amount of debt in a very well paid job which I was made redundant from back at the end of 2008. I contacted all my creditors at the time and sorted out a payment plan. It took me nearly a year to get back into employment on much lower wage by which time some of the agreed payments had stopped.

    I stupidly buried my head in the sand and continued to do so. I've had continuous problems since with my wife being out of work and once employed again suffering with periods of illness and no pay (zero hours contract), forcing us into payday loans and doorstep loans. Each month running out of money and desperately clinging to anyone who would help us making it through the month. Eventually debts were sold on and again I stupidly ignored them.

    Fast forward to now and I received a court letter advising of a claim from 1st Credit for a debt of £1,100. Again I buried my head and ended up with a CCJ. This has now turned into an Attachment of Earnings order that my employer has signed and returned.

    I've now read about Statute Barred debts...... Can I get this over turned and how??

    (I'm not that great with legal stuff and tend to panic, causing the head in the sand effect).

    I'm hoping for some advice. ( Sorry I now I said it would be a short version)

    Hi welcome to the forum

    This 1st credit debt.. when did you last pay anything towards it?? how long from getting the CCJ to the AOE being implemented?

      Good morning,

      Statute Barred in England and Wales = 6 clear years with no payments or unequivocal written acknowledgment of the debt.

      The relevant 6 year period start date varies with the type of account (?)

      Did you receive a CC Claim pack? If so did acknowledge service of the claim?

      This issue of a CC Claim stops the 6 year clock on the date of issue?

      What is the debt 1st credit has judgement for, credit card, loan. HP, bank account/od.

      When was judgment given.?

        Hi Stu82,

        Thanks for your response, I've done some checking today and it turns out I had a £1 monthly payment going out regularly until about 5 and a half years ago, so I guess I'm stuck. Looks like they got in just before the 6 years time frame. So I guess I'm stuck.
