Hi, My employers are currently in the process of making around 450 of the same grade at various locations redundant, their intention is to retain around 200 and offer an alternative role to the rest, the selection process they used in my case was not fair, they dictate to us when we are allocated our annual leave (allowing us to swap with colleagues) I was on my 2 weeks summer leave when they sent a letter everyone saying an email address will be live at mid day on a certain day and you must reply stating your prefered role on a first come first serve basis. I was abroad (2 weeks)when the letter was sent to my home address and still abroad when the email address became live so I stood no chance of retaining my current job and will be forced into one that I don't want. I have been doing the job for 13 years with 17 years to retirement, there will be people who have done the job for 6 months that will get the job before I do.
Would I be correct in thinking a tribunal would see the selection process was unfair as they should have given more notice to reply.
Also your opinion on my success if I were to take it to tribunal would be appreciated. Also I have always wondered how does a judge decide how much to award in cases like this?
