  • Hoist Portfolio CC claim

    Hello all
    This morning I received a letter from County Court Business Centre advising that Hoist Portfolio had made a claim as follows:
    Claim for sum of £5,620.19 in respect of monies owing under an agreement........... pursuant to The CCA 1974.
    The debt was assigned by MKDP LLP (Ex Barclaycard.
    The claimant claims the sum £5,620.19 plus Interest of £2,608.95 plus costs and future interest of £1.23 daily.
    I have registered with www.moneyclaims.gov.uk but have not submitted anything to them as yet.
    The claim relates to a credit card which I had some years ago, however because of divorce etc I did not pay anything off it since October 2009, the latest statement I have is from November 2009 showing a balance of £4,414.06, which is less than the figure stated by the claimant, furthermore the credit limit on the card was £5,000 so not sure how the amount outstanding could be greater.
    Is the debt statute barred as I have not been in contact with Barclaycard or anyone else regarding this claim since November 2009.

    Hi All
    With regard to my previous post regarding the Hoist County Court claim I have now been on line and completed the acknowledgement of service but not the defence, I have also prepared 2 letters for the claimant and their solicitors regard CCA and CPR.
