  • Lowells Court Claim-Surprise

    Today, Thursday 19 May 2016 a court claim arrived from a company called Lowelss claiming a debt of almost £1500 owed by my wife.

    This is the first time I have seen or heard of this claim for this alleged debt..
    Neither my wife or I have had dealings with Lowells. Their claim on behalf of their alleged client, JD Williams is not recognised or acknowleged as my wife stopped dealing with JD Williams over 6 years ago following their illegal application of penalty charges caused by them changing the payment dates without my wife's knowledge. Payment were set up by standing order, accepted by JDW, which you must be aware are made on tge same date each month.

    After my wife sent a hand-written letter of complaint to JDW, which went unacknowledged, she heard nothing more until we received this court claim today

    At that time, my wife had had mail gone missing and we believe her identity was stoled as at that time we lived in a multiple occupation housing association propert with known ciminal neighbours and then we moved to our new council home.

    This court claim from Lowells came as a complete surprise and caused extreme distress to my wife who suffers from life-threatening respiratory conditions, stress and panic attacks.

    This claim offers no proof of association with the JD Williams company and I underestand that a true signed copy on an agreement must be provided. I also understand that it is an offence to transfer personal details to third parties without the express consent of the owner. As neither my wife or I have never had dealining with this Lowell company, have they obtained this information in violation of the Daa Protection Act?


    Obviously. we need to defend this claim as well as make a counter claim for expenses and damages due to my wife's fragile health..

    I am retired and our only income is my reduced govenment pension and pension credts and we live in a councill home with rent and council tax paid.

    Due to my wife's ill-health I will have to deal with this and as I do n0t use telephones or emails I always communicate only in writing.

    If it is necessary for this to go to the Northampton County Court, I would prefer to attend in person on my wife's behalf and would insist that the solicitor/s for this Lowell ompany be present to be cross questioned on their alleged evidence to the court if indeed that evidence exists.

    I have read that Lowells deliberately procrastinate, provide false evidence and refuse to supply alleged evidence asked for under statutary rules. This is very worrying.

    I would be very grateful for ant advice about this.
