    Hello all. I currently work within a large public organisation in Scotland. For the last 5-6 years we have been forced to start work at 0645 on early shifts, however we do not officially start until 0700. Is this legal. Any advice on this matter greatly appreciated.

    It depends on the circumstances. If, for example, there are people on minimum wage then it's definitely illegal as they are not getting minimum wage as the start time is 0645.

      Thanks for your reply. We are not on minimum wage however we do not get paid until our start time of 0700. We had no say in starting 15 minutes early and do not have the option to start at 0700.

        Do you work more than 48 hours per week over a 13 week average ?

        If not it's likely that this is not illegal. Whether it's a breach of contract is another matter.
