  • DWP How long to process a claim

    The estate recovery department made a claim against my Late Fathers esate. It has now been 6 weeks and we /solicitor have heard nothing.
    Does anyone know the average time these claims take to be resolved?

    Hi, I can say unfortunately there is no average with this situation, keep on to your solicitor to keep on to them.Sorry if that is not what you wanted to hear but if you read on the forum similar cases you will see what i mean.

      Quote taken from a response by DWP to question about time limit to make a recovery claim:
      ." There are no set time limits. RFE needs to ensure it has collated all necessary
      information before a decision can be made. This process is dependent on the time taken
      to gather the information and is therefore outside their control. However all efforts will be

        Many Thanks for you're reply. Am i able to contact them direct? As this may well be charged by solicitor.

            They asked 2 weeks ago for my Fathers Bank statements. The solicitor, states they have every thing they need and is not overly concerned with there speed. More action above this will be billed!!!!

              No harm in giving them a ring, ask them if they have everything they need, mention too about the solicitor and his extra charges hence you asking.
              Probably Pension Credit they are investigating it is a nightmare that is often put on the laps of grieving families.

                  Ok think this is the starting place to contact, if it is another dept dealing with it they should be able to tell you.
                  Please update us on what happens as this will help others in this situation.

                  If the estate shows the person who died shouldn’t have got the income-related benefits they were on, contact Debt Management Recovery From Estates instead.

                    Many Thanks.
                    Have just spoken to them and where very helpful. I did'nt have the ref number but we did manage to locate my Fathers file.
                    I found them very helpful and polite. The lady I spoke to, would see what she could do, to help things along.
                    I just wonder what the solicitor would have charged for that?
                    So a positive outcome...Lets just now wait and see what happens.
