  • Please help Cohen and Howard threats......HELP PLEASE!!!!

    Hi All,

    Thanks for reading/responding to my posts.

    Back in 2007 I had a Capital one credit card which i defaulted on, this has now fallen off my credit report and I am certain it is statute barred. I haven't had a credit card for about 5/6 years, However recently i have been obtaining credit again (2 cards) to try and build up my credit score again. Since then i have started receiving these letters.

    Cohen and Howard states that the debt was bought from Robinson Way and they (CH) will apply for CCJ if I do not reply in 10 days ( i got the letter 30.4.2016) Just to show how old this debt is the letter came in my maiden name I have been married for 9 years.

    Please advise me what to do. This debt is statute barred so i wont be paying it.

    Hi Nicole

    You need to send a cca request to them

    if you look at the section received a claim there is a green box there with things in. That shot;d at least buy you some time

    Apart from that I am at a similar stage except mine is capital one with Lowell solicitors

        Do you know the approx date of the last payment on the account or you last acknowledged the debt?

        IMO they are just trying it on to see if you know your stuff or not ...

          I don't know the exact dates but I know it's 2007 or 08 for certain. I could get my bank statements

            As long as it's that far back you have nothing to worry about as rightly said it is SB so as Berti said send the CCA request asap with a £1 postal order marked "For statutory fee only" (on both sides) and await their response, Im very new to all this just like you so if anything i've said may be wrong i'm sure the knowledgeable ones will be here very soon ...

              Thanks alot Stu and Berti we are trying to save for a mortgage and this just frightened me, I am glad I took a deep breath and found the site instead of calling to company. Thanks once again i will keep you guys posted. Thank u

                IMHO

                A CCA request, albeit a useful thing to do, will not evidence statute-barred status.

                I would send a 'prove it' letter, asking for evidence of:

                1) Any payments made to the account in the last 6 years made by (Nicole), the date(s) paid & method of payment.
                2) A copy of any written acknowledgement of the alleged debt.

                & get proof of posting.

                Do you know who 'owns' the alleged debt? (Is it still Cap 1?)
                If someone else, have you received a Notice of Assignment, informing you that the alleged debt has been sold?

                  Who do i address the letter too. The letter i received states:

                  Our Client - HPH2 LTD (ex cap1)
                  Client Agent - Robinson Way
                  Letter from - Howard Cohen Solicitors

                    Imho, I would send it to HC, requesting that they pass it to their client as a matter of urgency.
