Court Of Protection Advice Urgently Needed

  • Court Of Protection Advice Urgently Needed

    I have registered in the hope of being able to receive advice regarding application to be personal welfare deputy for my daughter who is nearly 21, and is cared for by a private company employed by the local council. My ex husband and have have gone through a solicitor to apply to be joint deputy for my daughter who has complex special needs and is non verbal. The solicitor has been so unhelpful yet has been paid. Today I have received form COP24 to return by 19th April, the stamp on the court of protection order is dated 22nd March. This is the latest in a long list of trouble with the solicitor we are using.
    It is vital that i fill the Witness statement out correctly and I am seeking advice as to how we can ensure this is done without risk of it going to an oral hearing.
    Any advice offered would be gratefully received.

    Good afternoon, welcome to LB,

    COP 24 witness statement. Like any statement e.g. in regard to motor accident, is just your " story " in support of the application.

    You will need to state why you are making the application all the reasons why it's best for your daughter, how you intend to fulfill the tasks/responsibilities of being a welfare deputy.

    Put down what you wold say if the application did go to a hearing.

    Only you and your ex husband know all the details of what has happened and is happening now and why you are making the application.

    If there is pertinent correspondence that should be brought to the courts attention list each item as " Exhibit 1 etc. as in " On date I/we received a letter from ccccc stating that xxxxxxxxxxxxxxxxxx ( Exhibit 1)

    Be clear and concise.
