Can we apply for a set aside based on the delays and that Cabot have to prove the debt is theirs? There is still a payment going to the original collector moor croft and a payment has never been missed. Any ideas?

    Thanks
Now there is a judgement in place no one is obliged to supply you with a copy of the agreement the CCJ supersedes the original agreement entirely.

You will need to think on your reasons for applying for set aside:
    1.Claim Sent to wrong address.

    2. Payments had been made regularly to Moorcroft ( Evidence of said payment will need to be submitted.)

Problem: You failed to enter any defence at the judgment was made on the claimants favour because of this. Court may take a dim view of this, it'll be a case of finding out this on the day.

      Hi geezer

You have stated many times that you have made a CCA request, but you still haven't said what the debt is for (or have I missed something?)

Also, despite both the Claimant & their sols having knowledge of your current address, are you saying that they are still using a previous one?
