  • Sacked in case he had cancer

    My husband was employed on a six month renewable contract with a well known bank as a programme manager. He was terminated by his agent at the request of the bank as he may be a risk of being un available as he might have cancer. He had taken one day off to get results of a biopsy. He was sacked in the morning and the results came through in the late afternoon. The agent refunded his flights already booked and the bank hr rang him to sympathise and assure him they would look together with the agent to re employ him. This was in response to having emailed the bank HR following a call to ACAS. To date no job four weeks on and no sign of any.

    We are considering legal action but unsure of the strength of our case. We would appreciate any advice.

    He was terminated by his agent at the request of the bank as he may be a risk of being un available as he might have cancer.
    Do you have written evidence that this was the reason?

      We emailed the head of HR after discussing with ACAS and the agent confirmed by telephone the following day the reason was he was a risk of being unreliable as he may have cancer. Although no written proof was provided the agent reimbursed outstanding air flights and the banks HR rang him and sympathised offering to work with the agent to find alternative role within the bank. At no time was his performance mentioned just his risk.
