  • CCJ Mortimer Clarke-Cabot Financial-Capitol One- Please help!

    Hello everyone, please help me I'm so clueless about what to do now, I posted this in the wrong place initially, so sorry for that.

    Just before Xmas I received a County Court Claim letter with MC as the claimant (working for Cabot) I foolishly didnt reply to this and so a few weeks later I got a CCJ from the court saying I must pay £504.63 (this is with fees added) at £50pm. I can't afford this. I thought this was statute barred and was going to reply to the court telling them that I disputed the claim. I searched Noddle but nothing on there, I searched my old bank statements and found a payment made in Oct 2010 so not statute barred. So I wrote back to MC and admitted the claim, I've now got a letter saying

    'We refer to the above matter and your admission form dated 11/01/2016 and received on 15/02/2016.

    Your admission form was received out of time and we were instructed to obtain a County Court Judgement for £504.63 payable by monthly instalments of £50.00

    From the figures provided your total monthly income is xxxxx and your total monthly expenditure is xxxxx This means there is a monthly deficit of xxxxx and as a result our client feels your offer of £10pm is unaffordable.

    Please provide confirmation of your ability to commit to your proposed offer. We can confirm that our client is not requesting for an increased offer of payment but for clarification on how you can afford your offer of payment due to your monthly deficit'

    I'm not sure how to respond, just wish I'd come here first for advice.

    I cant afford the £10pm either really but thought I should offer something, I'm a 64 yr old woman on a pension and pension credit, I have no assets except a little 10 yr old car my son bought for me as I live up a very steep hill and cant walk up it, I rely on my car to get out (long term back problem means I take Tramadol and Diazepam) I'm so worried they will take my little car to pay for the debt, please help

      Hi Messy,

      can you say some more about your financial situation. Do you have other debts that you are paying? Other debts which have defaulted and where you aren't making any payment?

      Do you live on your own? Are you renting? Are you getting housing benefit and not paying any council tax?

        Hi thanks for you reply. I have one outstanding debt but not paying anything on it its been 3 years since I've heard from them.
        Yes I live alone. Yes I'm renting and I get full HB not paying any Council Tax.

          Sorry I forgot I do pay a catalogue as I have a basic bank account so no overdraft. When I was working some years ago I was on Payplan but had to stop it when I finished work. I get my pension plus pension credit plus a small private pension of £65 pm. These are my only incomings. Hope this helps.

            I'm not sure if you saw my previous replies? I do live alone, yes I rent, I get full HB, and don't pay council tax. I filled out a budget thing for them and sent it to them thats when I got the letter back, I havent sent them anything else since then and not heard anything as yet. I just don't know what to say to them, thanks so much for your help

              Sorry, I didn't see your previous replies.

              I was asking to check that there weren't any benefits you should be claiming that you aren't.

              Can I suggest you call National Debtline 0808 808 4000 and talk through your income and expenditure with them? You really do need an I&E which balances each month. I don't know what your running costs for the car are - these might be the reason you are having problems. I'm not saying get rid of the car, just looking at the facts.

              One option would be to go back to them and say that you have discussed this with National Debtline and you feel you really can afford £10 a month.

              I there any chance your nice son could help you out with this problem? If he could offer some money as a full and final settlement, they may be prepared to take less than the full amount as they know you can't afford to pay anything much each month.

              Or if he could pay the £10 a month for you?

                Thanks for the reply I have done and I&E on National Debtline which I have saved I tend to juggle things each month to stay out of trouble, I just didnt know what else to say to them, they obviously know I cant afford the £50pm already ordered by the court. I'm loathe to ask my family as they do help me in a lot of other ways, they have lives to pay for too, I'll just reply to them that I will pay the £10 I've offered or maybe what they would accept as a full and final settlement maybe that would be better? Thanks again for you help, I dont feel as helpless as I did a week ago

                  "juggling to stay out of trouble" is OK for a few months or if you think your situation will improve. If you are on pension credit, this is pretty unlikely.

                  If you were my mum, I would prefer you told me about this problem. Even if I couldn't afford to pay the debt off, I might be able to say something helpful.

                  It's not as though you are busy running up new debts, is it? This debt and the other one you are ignoring are your only problems.
