  • Bailiffs !!

    Hi, could someone help me please , am new to this. I had a letter through the door delivered my hand from marstons bailiff. Apparently a fine from 2014 dvla. This was a really rough time in my life meaning my partner left me with a round baby then my landlord was repossessed. She ended up tricking me to leaving and changing the locks and passports and paper work and a few belongings were still in there. I went to a solicitors and was not entitled to legal aid (this is not my problem just explaining why I have no paper work) I received a fine about my Uninsured veichle and couldn't afford to pay it so it went to a Hertfordshire court with whom would only accept a payment plan much higher that I could afford but said it couldn't be any less or bailiffs would be round. I paid two payments and that's when I became homeless for nearly 6 months. I say homeless but I was in a hostel way out and couldn't even afford the travel to work as the rent was the same as a two bedroom property! I found a private rented place and had to borrow/raise so much money my finances are still so bad. I work but receive tax credits and housing benefit as wages just about cover my childcare. Anyway this bailiff says he needs £540 before the end of the week .. I had no idea this court order was issued as I presume correspondence has been sent to old address although my veichle is registered with my name at new address and bailiff found me so unsure why paper work wasn't sent here. Is there a way of appealing to the court or dvla as the fact I had no letters etc ?! Bailiff said if my appeal is successful the whole amount gets refunded to me is this right ? I just don't know what to do I feel my only option is to et a payday loan to pay this thanks in advance I have been crying all day scared he's coming back!

    I believe you can ask for a statutory declaration as you didn't know about the legal proceedings. Is this county court or Magistrates issue?

        You can't submit a Stat Dec as you confirmed in the initial post you knew about the fine & made 2 payments. You should contact the Court and explain your change of circumstances, they may tell you tough but you cannot pay what you do not have. For Magistrate Court fines there is the power to force entry but nowadays there are so many household items that are exempt from seizure he would be wasting his time.

          Yeah I can borrow the money but that's hundreds of pounds of court fees etc because I didn't reply. But all letters were sent to old address.. However they knew to send bailiffs to the right address ay! The court officer was rude and hung up twice saying nothing they can do speak to bailiffs and bailiffs said speak to dvla who won't accept anything unless it's in writing.
