    Hi.
    I've just received letters from Lowell and Hoist portfolio in relation to credit card beds going back around 5 years. There's balances of around £1200 on each. Letter is asking me to make contact but when I did they were rude and pushy. I'd be grateful for any advice on how to deal with these people. One debt is due to be off my credit file 1/17 and the other 5/18. Should I offer to pay a small amount each month to avoid CCJ'S or will this reset the date for it being statue barred? . I'm really stressed out and am loosing sleep with worry. Thanks in advance.

      Hi.*

        Best go to http://legalbeagles.info/forums/foru...-a-Court-Claim , see the info on CCA s78 requests & send as shown (Adapted by yourself to suit). (Not the CPR letter yet, as you haven't mentioned any court claims).

        If it were me, I wouldn't pay anything yet.

        When (if) they reply with the documents, post them on here (separate threads for each one).

              There is nothing to stop them issuing a claim at any point, unfortunately they don't even have to have the agreement in hand to issue a claim via the Northampton County Court Business Centre as claims through that court are issued electronically.

              The point is that even if a claim is issued they have to prove their claim.

                Lowell unable to provide documents...

                Hi,

                I wrote on here a few weeks ago about a letter received from Lowell. I was kindly advised to request documentation under S77/78 of the CCA 1974 which I done so and they have sent 3 separate letters, one which contained some copy statements, the second was inviting me to pay a 20% reduced payment and the most recent is the attached letter with the 50% reduction and confirming they are unable to issue Court proceedings.

                I'm not sure of the next step....do I pay the reduced amount or not?

                Thank you in advance for your help. :-)

                  Lowell can continue to press for payment and you can continue to ignore them!

                  Is Lowell on one of it's multiple phone calls, texts or e-mail campaigns yet?
                  What is the total amount they are chasing?

                    Am I right in thinking that if I don't pay anything and simply ignore them no further damage can be done to my credit file?

                    What would the implications be if I offered a small settlement just to get them off my back?

                      Hi bezbo,

                      Any payment will only get the credit file entry will result in the credit files being marked " satisfied or partially satisfied" the entry will remain of file for the rest of the 6 year period when it will be removes paid or not.
