  • Dispute with landlord over compensation

    I moved into a rented house in September 2015. In December my health started to deteriorate, I am asthmatic, at this time I noticed damp patches starting to appear on the walls. I reported this to the letting agents and they sent someone to look at the problem. There was a leak in the roof which they repaired straight away but the property also had damp and rising damp which required the plaster to be taken off and the walls to be dry lined. The work was scheduled for January and my partner and I moved out of the property for 2 weeks whilst it was done. When we came to move out the extent of the damp was revealed. The mattress from the bed and pillows had to be thrown out along with many items of clothing and shoes as the damp had penetrated the wardrobes. We have asked the landlord for compensation for our losses, we have pictures, of the damage but he is refusing. Where do we stand? Can anyone help please the stress is affecting my relationship with my partner.

      Its hard this one and not the most unusual of situations.

      Technically, If the damp can be proven to come from the faulty roof, then the LL is responsible, But any LL is going to defend that saying not enough ventilation ( windows open ) by tenant. Its proving fault iether way thats difficult. Was it rent free for the period you wasn't there, and did he give you any towards moving fees.

        We were rent free for the two weeks we were out but we had no other help. We have had to pay for a carpet cleaner when we have moved back and replace all the damaged items. The previous tenant experienced the same problems with damp and have given us their new address if we need them to support us.
