sorry title should read Restons. They have given me until the 8th March to pay in full or set up a payment plan. Any advice please. I was sent a letter from Restons threating court action CCJ regarding an old credit card that I defaulted on. It falls of my credit file April 2016. The first sent was sent in June 2015. I sent the usual letters to both Restons and Cabot. Never heard anything back from them. I have now received the same letter again for the same account. Do I sent off the usual letters again and the statutory 1 pound fee. I just wonder if this works in my favour as they never responded to the last two letters. Any advice desperate as this debt is 6 years old next month?

    thank you in advance.

      Hello Fred,

The fact a debt is removed from credit reports does not always mean it is statute barred.
When was the last payment or written acknowledgment of the debt?

Statute barred in England and Wales = 6 years no payment or written acknowledgment of the debt.
The start date of that 6 year period would be approx. months after the last payment as a guide.

Yes send another CCA Request to Cabot.

Thank you Nem. I don't know when the last payment was made. I think it must have been before the account went into default. I have never actually acknowledged the debt to Cabot. They started chasing last year. I think I owed around 250, most of them were charges. I stuipdly ignored the account, hoping it would go away. I dont have any details. I'm just hoping and praying I can fend the DCA and Restons off till next month. Thank you again for advice. Much appreciated 😊
