  • Recovering Costs

So, after successfully defending our case, we are now going through a 'detailed cost assessment' process, and have been informed that there is a fee for this ( £ 200 or £ 332 with a hearing )
So, more money to be 'thrown at the court' .
Having already incurred costs of approx £6000 defending this nonsense, It appears the Court requires us to waste even more money. The point of the matter is that we are more than confident that we will never recover any of our losses, and we are only pursuing this as a 'point of principle',
This individual should not be allowed to get away 'scot free' by employing the Court process to harass our family for 2 years.
    So my question is this,
Once the actual amount of 'costs' have been determined. How much more money will we be expected to fork out to the Court service in order to enforce recovering these costs.

    Re: Recovering Costs

Is this in relation to a previous post you have made? If so could you summarise the background again for ease of reference.

enforcing a money judgment provides a variety of ways, and depending on the route you take may cost more or less money. A popular enforcement is of course taking control of goods which is enforced through a county court or high court and is quite a speedy process. I believe you can go direct to the high court (cost more) but enables high court enforcement officers to seize goods that is the defendants and sell to repay the debt. If made through the high court there is no need to notify the debtor they can just show up - exactly in the same way as that channel 5 programme that has been on recently. Another option would be an attachment of earnings order where a portion of the debtor's money is deducted by the employer and paid to yourself.

Other ways could be a charging order, although this can be slow and costly and may not give you the end result or a third party debt order which a person's bank acocunt is frozen in favour of the creditor, this would require you knowing there was money in the specific account which covers the debt owed.
If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you

      Re: Recovering Costs

The Problem is, now the claimant has lost the case, (a case which appears to have been sought in the hope of frightening a financial settlement) a settlement which would then be used by the claimant, to pay mortgage arrears, unfortunately this little scam failed, and now the property has been repossessed, and consequently the claimant has disappeared. I have no expectation of recovering any of my costs, but as a point of principle, I will not allow this attempt at fraud and extortion to be brushed under the carpet.
