    Hi,

    I wonder if anyone can provide any clarity on a freehold query please?

    We own a purpose-built ground floor maisonette as leaseholders. Our upstairs neighbours own the freehold. Can anyone clarify whether this means they have sole responsibility for the outside/roof of the building? We have issues with leaky guttering at their level which is causing damp to our bay window, and a damaged chimney (down which we can hear rubble falling and we think birds are living in it!) We've mentioned the chimney issues before but I don't think they've looked into it yet.

    I understood that freeholders are responsible for the outer shell of a property and therefore we legally have no financial responsibility to it. We get on well with our neighbours and want to be sure we're apportioning responsibility for repairs fairly and legally.

    Can anyone advise please?
