I hope this is the right place to post this. I have recently recieved a ccj from a builder I hired to refurbish my bathroom and kitchen as well as some plasterwork who I had to let go of as he didn't complete any of the projects by the quoted date and hadn't even started any work on the kitchen. I was wrong to pay him anything, but have unfortunately already parted ways with a large amount of money. My flat was left in an unlivable condition and I still am not an to live there.
I went on holiday on the 6th of January and came back to a claim against me from the builder which I had lost by default as I was not there to recieve it. I would like the opportunity to defend myself and issue a counterclaim for the money already lost so I have requested an N244 form.
The issue I have is that the claim is dated the 31st of December and service is taken as five days later, so the 5th of January even though there was a bank holiday and a weekend in between. I have my itinerary for the evening of 6th January and was at the flat with no letter recieved upon leaving at around noon on the 6th. I'm just worried that my N244 will automatically be thrown out if the date of my flight was 1 day after the date of service and would like to ask your advice as I can't afford to lose any more money, but feel I have a strong defence.
I would also like to ask how much time I have to send the N244. Is this also meant to be sent within 14 days?
