    Hi, I had a lot of old debts. But one debt been charged on my property about 8 years ago. All I got in post was the final charging order which says payment of the sum of 3300.00 owing under judgement or order given on Feb, 2008,with any further interest becoming due and 210court cost . Since I was under a lot of stress I went through a DMP through a company until now.
    I think lowell didn't serve me properly with the court orders or letters to let me know they are taking me to court. What can I do now to sort this charge notice against my property.??
    Because I was making payments through a DMP I can see the amount owed has slightly reduced.
    Does anybody know what can I do to sort this out. I have stopped all payments to all DCA s now.I am only worried about this debt which has a charge notice against the property. And lowell are chasing me .
    Any advice would be appreciated.

    Am sorry and didn't realise that no one has answered you.

    A Charge is security for the debt that was owed and will include interest on the charge. A charge is not an ownership interest, and the good news is that although the charge could be used to force a sale, it requires a court order for this; but as far as we're (Legal-Beagles' community) all aware sale is very unlikely to happen. Once a charge is there they're very difficult to remove as the creditor will just say I will not get the debt paid unless the charge is there. It just means the charge must be paid off first before you sell the property etc, which you'll find they will have a restriction on the land register to protect their interest.

          Hi, Yes it is. This is one of many. But this one was dafaulted, and has a charge notice issued on February 2008,by lowell.
          (my other threads under title old debts on the forum).
