scaffolding on my land

i have a neighbour who in the past as put scaffolding on my property 4 years ago with out permission damaging plants solar lights and irrigation system about 100 pounds damage.they removed the scaffolding the next day but refused to pay.
last week they asked for permission to put up the same scaffolding we refused now they threaten us with a Access to neighbouring land act 1992 so they can repair the roof. how can we stop them as they will damage the plants and new irrigation system.

They will need to go to court to get an order for access if you refuse to grant them access to your land. You could also raise the point that they have caused damage, refused to pay and the same scaffolding is likely to cause the same damage.

Get something in writing and signed by them that they will pay you £100 for current damage sustained before you agree to to put up the scaffolding again and they will indemnify you for any further damage caused as a result of the scaffolding. If they refuse, they wil have to make an application to court and you could raise your points there. Make sure to take photographic evidence of any damage caused beforehand.



EDIT: just saw that the initial scaffolding was 4 years ago, forget asking for the £100, is this the same business doing the work? Either way, put something in writing to say they will indemnify you, and take all of their contact details e.g. a name and address maybe look them up on google too just in case they give you false information.

Hi. It may be a god idea to contact your house insurance company ( if you have a building insurance) and see what's their advise. I believe that they should have an interest in it. I would advise that you do everything in writing, letter confirming their request, your concerns and complaints ( perhaps not a refusal if they get an order to force you to give access) your claim from previous unpaid damages, your conditions fro granting access, time limit, state you expect your property to be returned to after the work, guaranteed of restoration for any damages, take photos of before and after.
If they can not agree to your reasonable and fair request, then you can prejudice yourself and comply to their request.

Also look at charging them on a daily basis for use of your land which should cover any possible further damage. Use a contract.

I agree with you that you need to solve something with this, but sometimes I came across the problem of leaking roofs personally these guys from Brisbane help me with the roof restoration
