  • Concluded Case but still help needed please??


    Dear Team,
    I wonder if you could be able to help in my case.
    I had a credit card dated back to 2001 and due to my severe financial difficulties and family crisis I defaulted. I entered into DMP which I couldn’t continue up to 2008.the debit was sold to DCA who issued CCJ against me. The set aside and witness statement together with the hearing date at my local county court been all done, just before the hearing date the claimant was unable to provide a true CCA therefore, served a notice of discontinuance a copy has been sent to me and to the court with subsequent order of “hearing vacated”.
    I phoned the court asking if anything needed to be done they said no!
    Upon obtaining my credit file the CCJ still showing in only in one credit agency plus the same amount with a different credit card no and lender!! Also I checked the trust on line and it’s still there.
    Can someone please advise me what the best course of action is?

        Hi,

        Which credit reference agency is showing the CCJ? How long ago was the set aside / discontinuance order made?
        This is not Call Credit / Noddle is it?

          This isn't a CRA problem if the CCJ is still showing on Trust Online.

          I would phone the court up and ask what is happening.

            The CCJ is appearing on a CRA file!

              Yes but the CRAs take CCJ data from the same database as Trust Online, not from the creditors. This isn't a "creditor reporting the wrong data" to a CRA type of error.

              Either the CCJ has not been set aside, or the court records haven't been updated correctly.

                Contacted the court the following day of reieving the notice to ask about further course of action, they say nothing to be done!

                  Thanks for the quick reply, sorry I think I replied earlier.
                  It took place end of Sep 2015.
                  Its equifax.

                  I do agree with debit camel that, either the CCJ has not been set aside, or the court records haven't been updated correctly.

                  I have looked into CPR regarding right to apply to set aside rules 38.4
                  (1) Where the claimant discontinues under rule 38.2(1) the defendant may apply to have the notice of discontinuance set aside.
                  (2) The defendant may not make an application under this rule more than 28 days after the date when the notice of discontinuance was served on him.

                  can I apply now? and why I have not been informed by the court?

                    Trust Online is a record holder, you need really to contact the court manager at the court where the judgement was mad,
                    there is a backlog in the system but I didn't think it was that long.
                    Also if you raise a notice of dispute/correction with the CRA's they will investigate the matter.
