      So, its the end of April and I have still not heard anything. This is well beyond the 40 day mark.4

      Where do I stand now?? Should I write to them and ask that they wipe the debt as it is not enforceable?

      The wrote to me in December asking for 40 days and I have heard nothing??

      What should I do?

          Should I say that as the 40 days have expired I can expect them to write clearly stating the debt is unenforceable??

            Reading back I think they have not been able to find/ acquire the agreement don't expect civilities from this bunch they are unlikely to have the courtesy to say they have failed.

                  I'm thinking more about my credit file though. It's showing as a default and I would like to resolve it. In the absence of an agreement, could I ask for it to be removed from my file?

                    Hmmmm seems like the site's got hiccups!!

                    Unfortunately lack of the agreement does not mean the debt does not exist so it will be reported inline with current regulation until the 6th anniversary of the default date.

                      Well that's just rubbish isn't it. So ignoring them is the answer for the foreseeable? No way of getting this off my file.

                          Unless you can provide information that show the default should never have been recorded or was recorded unreasonably late there is no chance imo.

                              If you pay the debt off the entry on credit file will be marked " settled " and remains as such for the balance of the 6 years from the default date.
                              As to improving your " credit score" much will depend on what else shows.

                                Hello again,

                                Today I've had a letter from the solicitor saying they've noticed I've not been making payments and unless I start doing so then they will send their big boys out to find me. Joking. Sorry. They made a threat to pursue legal recovery.

                                To date I've never received official notification that the debt is enforceable. If you read through the tread you'll see they asked for 40 days (back in December) and never came back to me.

                                Today they've sent me an income and outgoings form to complete.

                                Questions are:

                                Do I call them and acknowledge the letter?
                                Do I make them an offer?
                                Do I wait and see what happens?
                                Do I write asking for the CCA thing that I was advised to do.
                                Genuinely appreciative of all of the support.
