  • How much does it cost to have a CCJ set aside

    Hi all,

    how much does it cost to have a CCJ set aside. I didn't realise i had been issued one and now it has been passed up to the High Court for enforcement. The CCJ was given 2 years ago from a company i don't even know (Brunel Franklin)

    I am at my wits end as i do not know what t do........I have read that i can go to prison if i do not pay a HCEO or if i refuse him/her entry into my property.

    Good evening, welcome to LB,

    The cost of an application is £155.00.
    A set aside application should be made as soon as possible after the judgement, you will have to show
    reason for the application and that you have a defence with a reasonable chance of success to the original
    claim.
    Debt is not a criminal offence in England.

    More history of this will help us to advise fully.

      Just came back to me Brunel Franklin is a claims management company, have you used such a facility for example for a PPI claim?
      This could be for unpaid fees/ no win no fee claim.

        Hello thanks for your reply,
        I moved over two years ago, so i never received a court summons or paperwork etc

        Today i received a letter from Andrew Wilson & Co giving me 7 days to pay £1944.26 + £90 compliance......I don't have £155 either to pay fees to the court, i feel that my world is tumbling down very very fast and feel very depressed

        They claimed that they got me back PPI from welcome car finance from a car i had on finance with 8 years ago.....yet i did not receive any payment, instead i got an invoice for fees payable to Brunel Franklin

        Naturally i thought no win no fee and did not pay them as i never received a penny
