  • Hello & CCJ Help

    Evening all

DH had a CCJ about 5 years ago and now he can't find the paperwork relating to it.

He has rang the court and they say they don't keep records of the CCJ agreement and suggested that he speaks to HSBC.

He's never had a statement from HSBC and would like to find out how much the balance is and when it will be paid. The agreed monthly amount is paid to HSBC directly according to the Direct Debit.

I just don't want him to contact HSBC and they start to pressurise him to pay more or even raise a new CCJ. Can they even do that?

At then end of the day all he wants to know when it will be finally settled. Will they stop taking the money when it is paid?

    Any advice greatly welcomed.

First of all write a letter to who the debt was with. Then get an SAR Subject Access Request. To get all the information. What was the CCJ for overdraft charges etc?.

      Thanks for your reply.

Is there a specfic letter he needs to write?

I'll have to research an SAR as I don't know what that is.

Yes, it was for a loan, overdraft and charges I think.

No Just write to the bank mentioning that you need an SAR Subject Acess Request and write a cheque out for £10. They will then send you all your bank Statements Loan information etc. If you had a loan there may have been PPI on the loan also claim for this back why did you get a CCJ?.

SAR = Subject Access Request - https://ico.org.uk/for-organisations...ccess-request/ xx
