Some of the members on here may have read a previous post about a social worker who lied in Court (http://www.legalbeagles.info/forums/...rts&highlight=). Well, now the successor of that social worker has written to the nursery school which the children are attending, claiming in the letter that one parent alone had been given sole parental responsibility for making decisions about their education and all other matters. This is a lie as the court order gave that one parent residence only. The order states only that the children would reside with the one parent, with contact for the other. It makes no statement or instructions about decision making or other parental responsibilities. What can be done about this to correct the situation? It would obviously be pointless just telling the school without providing proof, as they would probably, just like everyone else, believe the social worker without question! Would showing the court order to the headmaster of the school to confirm the facts of the order constitute disclosure of court proceedings in the family matter and therefore be a contempt of court; if so what else can be done?

There is NO order as to parental responsibility and therefore this is shared between the parents as in law, not given to one party as misrepresented by the social worker!

Your guess is as good as mine! Maybe to show that they can do as they like and gloat about it?
Get a copy of the letter and, if you can, email the social worker with a scan of the letter and play dumb. Your friend received the letter and was questioning you about it all and you have said that it was probably a mistake. Ask her whether it was and if not, to clarify why she has sent out the letter since there is no court order to this effect.

You need to play dumb as to why the letter was sent to the friend(that is a breach of Data Protection Act 1998). You need to find out why she sent it to the school since there is no court agreement that states that one parent has more authority over the education of the child.
