This is my first time posting. I am hoping someone can help me with some advice. So here goes:
I have a CCJ on my credit file for a disputed HIP pack with an estate agent. The court found in their favour by default, as I was unable to attend court on the day. When the judgment was issued I sent a cheque for the full balance within 30 days. The claimant sent the cheque back to me and said I must now deal with the debt collectors they had instated. I disputed this as they had passed it to the debt collectors after I had sent payment and they eventually cancelled the debt collectors and dealt with me directly. The CCJ has been satisfied and paid in full for some time now. However, I have only just become aware that if I paid it within 30 days it wouldn't have gone on my credit file. 5 years on and it is still sat on my credit file. The estate agents have agreed to sign a Consent Order to say that they are happy for the CCJ to be removed as it has been paid in full.
So my question is....do I still need to fill in court form N244 (Application Notice) to have the CCJ set aside and send it in with the Consent Order or can I just send a Consent Order in on it's own? - Keeping in mind that I have to pay £155 for the N244 Application Notice.
Also, does anyone have a Consent Order template or could anyone help me with this. Would be very much appreciated!
