The claimant's claim was dismissed by the Judge, I'm aware they had two options, either apply to have the decision set aside, thats gone now as option, but is there a limit after which they can't appeal the judge's decision?

There are strict time limits imposed in appellant courts within which an appeal must be lodged. Whether or not an appeal will be made must be decided promptly. The default period to lodge an application under the Civil Procedure Rules is 21 days, however this may be extended or shortened by the lower court
