  • Hi people, new member needing advice

    I've received a letter from Mortimer Clarke threatening to start legal proceedings for a CCJ against me for a company I had HP finance with over 13 years ago. I had been paying off the default over the years and to my knowledge was free from this debt years ago. Now, I'm being pursued for another £633.28 but when I spoke to them they claim they have my origina signature agreeing to the HP finance but cannot supply me with a complete statement breakdown of how much I paid. Without this info I cannot prove I have paid it all so can they proceed to court without a statement of payments made? They could be adding this on as interest, or charges, who knows. What do I do?

    Don't speak to them on the phone do everything in writing or by email this gives you a paper trail. If the original finance was HP then ask them who the HP was with and send a £1 postal order asking for a copy of the agreement under the Cuonumer credit act . If they do not have it chances are that they cannot continue with he action as they cannot prove the debt . The other thingto ask for is a copy of the statemetn . Wiser beagles will be along later and give you proper guidance .

      Thank you Seduraed, I have spoken to them once on the phone when they said they are proceeding with court and when I asked if they have a statement of my payments they said no, but they have the original signed agreement. Can they proceed to court without sending written confirmation first?
