    Does anyone know how I can take the DWP to court and claim compensation?
    I ahve run out of ideas after enduring their nightmare for the lst 5 years
    As they have cheated me out of my business and lefft me destitute on just £45 per week working tax credits????

    Simple answer is no

    If you have a valid complaint you fIrst go through the tedious internal complaints procedure. Then if necessary the Parliamentary ombudsman

    Then if an error in law has been identified a Judicial Review

    Case law has already decided this matter with reference to an individual wishing to claim against the Child Support Agency.

    Put simply regulatory controls are established to deal with any grievance

    They cannot leave you just on £45.00 a week working tax credits to live on
    £71.40 is the mnimum the Government say you need to support yourself

        I like the corporate speak of we got it wrong as "Maladministration’

        It should be "maleficence" in public office

        Definition of Maleficence in public office

        The offence is committed when:


        • a public officer acting as such
        • wilfully neglects to perform his duty and/or wilfully misconducts himself
        • to such a degree as to amount to an abuse of the public's trust in the office holder
        • without reasonable excuse or justification

          Hi thanks for getting back too me

          Yes I went through their tedious complaint procedure where they just lied through their teeth
          Then I went to my local MP who advised me to make a fresh complaint to the Independant case examiner who upheld my complaint,but all I got was a lousy faceless cowardly apology letter which does not change the hardship taht they have caused me.
          So the MP told me to take my case to the Ombudsman who have come out with their own load of rubbish that there is a gap in my complaint?
          But if the Independant case examiner found in my favour than so should the Ombudsman

          I do not know what they are on about a gap in my complaint if it was a fresh complaint which the Independant case examiner took on and upheld my complaint??
          So they all have left me on just £45 per week, yet the Govt states taht you need £73 per week to live on, let alone to live on and run a small business

          Also they Walthamstow Job Centre/DWP stopped me from doing vol work at London Zoo, and when I challenged them as to why they had changed my signing on day I was given 3 different answers by 3 different members of staff
          But they claimed it was because of my NI number whic is rubbish as my NI number would be the same on a Monday as it would be on a Friday
          So they are talking rubbish yet they get away with it??

            Were you given the option of appealing the decision of the ICE at the time? Or asked if you were happy with the outcome?
            Same for the Ombudsman ... did you appeal their decision? Were you given an explanation as to what the "gap" in your complaint was?

            your signing on day is, I'm afraid, dictated by your NINO :sorry: It stems from the DWP (JCP) using the last two numbers of your NINO to determine your "pay week-ending day" - http://webarchive.nationalarchives.g...fits/DG_178593
            (Last two numbers of NINO ~~~~~ Pay week-ending day)

            00 to 19 ~~~~~ Monday
            20 to 39 ~~~~~ Tuesday
            40 to 59 ~~~~~ Wednesday
            60 to 79 ~~~~~ Thursday
            80 to 99 ~~~~~ Friday

            For example, if your National Insurance number is QQ 12 34 56 A, your pay week-ending day will be Wednesday.

              I have replied to the Ombudsman, but they are now saying taht they will review their procedure but not my complaint
              As for the Independant case examiner I do not have anything to appeal as they upheld my complaint which is why I am cheesedoff with the Ombudsman as surely if the Independant case examiner upheld my complaint so should the Ombudsman??

              As for my Ni number and teh job centre changing my signing day
              How come I used to sign on on a Monday, then they changed it to a Friday, the day of my vol work at London Zoo, but my NI number would be the same whether it be a Monday or a FRIDEYSO TEHY DID NOT HAVE TO CHANGE MY SIGNIG DAY sO iT MAKES NO SENSE WHATSOEVER?

                  Yeah I ve tried that and I am awaiting their response but I believe that I will just get yet another faceless letter of apology which of course does not change anything.
                  Also I believe that it is fraud that they have committed as the grant that I was signposted to by 5 orgs/agencies did exist when they said taht it did not, even when it was advertised on both Govt websites at that time, which must be false advertising at least?i
