You can complain to the business again......make some changes to the complaint & then see if they will issue a further final response. Then go back to the FOS within six months.

Can you ask for senior ombudsman review - they said end of discussion - no more correspondence !

The company raised the time bar issue ! so they won't look at again - pointless contacting Barclays - they are scum

I have had dealings with both the F.O.S. and L.O.S.

It was a frustrating experience, even when they gave partial judgements in our favour.

The staff by their own admission were 'lay people' and gave awards based on their 'lay opinions'.

Cases were also referred from the adjudicators upwards to the Ombudsmen themselves. They claimed to have read all the evidence available, which for a variety of reasons was clearly a lie, and just reinforced what was told to them by their adjudicators and merely signed off their judgements.

Likewise, in 2 cases, where they wanted additional evidence from me, no reference to it was made in the judgements made.

I was left with a distinct impression of people who hadn't a clue what they were doing, let alone the relevant sections of law which applied.

Likewise, I refused their judements in some cases , since it would have prohibited court action, which I am now going through with certain companies.

As to my local M.P., he was a waste of space.

Stephen - had same issue with another case - Halifax share dealing - but took them to court - unfortunately I would be frustrated by the long stop rule in the courts - so the ombudsmans decision is a hammer blow for me - Barclays are playing hard nose - not sure how i can change complaint - Going to put together a brief chronological summary - pass to everyone i have contacted - FOS- I/A various consumer champions and MP - I am hopeful it will have quite an impact - will post it here first for feedback

LOS= I assume is Local Ombudsman Service.

For reference, my understanding is that even though you have got a judgement from the FOS that does not stop you from proceeding with a legal case against the financial institution with the argument about the issue of 6 years or 12 years in the case of mortgages ie statute of limitations.

I've been through the FOS and know first hand that it is disappointing when you lose a case and I went through as far as I could ie independent adjudicator. However, I've also worked with the FOS, to deal with financial hardship claims during the time when there was the high court case on bank charges, to better understand their position and to better understand how to fight a case that was winnable to them. In that regards there were many successes because of that information that I gleaned from them.

The difficulty that we have is whether the case is challengeable or not via the legal route which can be done by yourself. Sorry to sound stupid Fred but can you submit another complaint to the business with further evidence and changes, receive another final response and if rejected, submit again to FOS ?

i.e. original PPI complaint sent to bank, not up-held, passed to FOS and was also rejected. Now transpires that after locating additional evidence, there was a previous account taken over by bank concerned in which was not previously mentioned. I have statement details but the bank have none as per my SAR or any agreement details. I have proof that PPI was added by bank automatically as I have located insurance postal application details in which were not completed.

So therefore previous complaint reasons ignored by business, FOS and eventually rejected.

Obtained additional details after and can proceed with another similar complaint to the business ?

An example would/could be...................I complained about the interest charged on my account being unfair & it was ruled in favour of the lender (1st attempt)

I complain about the interest on my account being unfairly calculated as the lender has been fined for manipulating LIBOR rates (another go)

The business can refuse based on the complaint/s being too similar, the above being the same from a different angle & because of known issues therefore they would struggle to argue with you or the Ombudsman & an investigation would ensue.

I also had a previous PPI complaint rejected with a certain bank who were later fined for their handling of many complaints. I was hoping that they would have contacted me to re-open my complaint but I have heard nothing since.

Would this also apply to the Underwriter angle (in which was never previously considered or mentioned) as opposed to the bank ?

Yes most definitely you can submit the same claim with additional new evidence as this is what I did and I succeeded...you can ask for a review of your case stating that you have additional/new evidence, the FOS will assess your additional/new evidence and if they consider it to be new evidence, then they will agree to review your case, get your local MP involved, that`s what I did :-) Good luck xx
