    I'm starting to think there's only one option "a race to the finish line" gaining the court order you mentioned and sell the property myself, and stopping them from selling it on auction!! even tho it's an profitable asset.

        It seems they can do anything they wish and as they are unregulated there is no come back. Even the courts come down on there side.

        I was able to prove in court that the bank had conferred the power of sale on the receivers in breach of my mortgage deed but that was AFTER the receivers had 'sold' five of my properties and got away with it!

        I think you need to get a solicitor who knows the subject to check over your mortgage deed to make sure the receivers have been validly appointed and maybe seriously consider selling the property yourself. At least, get it valued immediately.

          Hi Clarke, I think you should have your property valued immediately and also, see a solicitor who is an expert in the field to check that the appointment of the receivers is valid and definitely consider selling the property yourself by applying to court under section 91 of the LPA. My receivers 'sold' five of my properties in spite of the fact that the bank had conferred the power of sale in breach of my mortgage deed but they all got away with it!

          You need to take urgent action....I didn't and regret it now!

            Another thought. If you talk to your bank be sure to record the phone call and/or get any promises they make in writing. Banks have been known to take money from people to bring their mortgage accounts up to date and/or promise to dismiss the receivers and then don't do it and again, the courts will support them! BE VERY CAREFUL!
