  • How do I apply to Court to dismiss a claim put on hold

    In January 2015 I received a court claim by Mortimer Solicitors representing Carbot financial over a credit card with Capital One. In my defence I requested that they provide documentation of the original debt. They responded on 29.1.15 saying that they had written to the original creditor asking for the said documents and told me that the case will be on hold while they wait for the documents. My question is, how long will this case be on hold since it is now exactly 5 months? How do I word my application for it to be dismissed as without basis since I totally denied that I owe them any money in my original defence. Thanks in advance for your help.
