  • Hello, advice with a will and probate please.

    Hi, I'm after some advice that I have been putting off for some time. I keep thinking about taking action but then don't bother as it's a difficult family situation and I'm not sure whether to just let it go. My wife then encouraged me to contact this website for advice, so here goes.
    My mum died about 2 years ago and left a will, however since my mums funeral I have not received any correspondence regarding the will. I have one sister who lives some distance from me and over the years we have not seen much of each other and I have not seen or heard from my sister since the funeral. Time went on and I thought that she or a solicitor might contact me about the will. My mum had property and a few bank accounts. About six months ago I discovered you could obtain a copy of the will, which I did and will upload a copy. I will only upload the first page as the rest of the stuff seems pretty standard. It says that I am a joint executor with my sister, should I not of been notified and sent a copy of the will? I contacted the probate office about this and they told me I had been placed as power reserved but wouldn't i of had to sign something to agree to that? Also point 3 and 4 confuse me, did my mum intend her estate be shared equally between us as point 3 indicates this but point 4 names my sister first and says she hold the fund absolutely, so is the estate to be shared or to go solely to my sister? Have thought of contacting the solicitor who drew up the will to see why they had not contacted me, do you think this is a good idea. I don't really want to contact my sister because apart from feeling awkward I'm worried she will not be honest. The propery is up for sale and I don't have any knowledge of other accounts that my mum may of had. Would be very grateful for any advice, thanks.

      Hello Matt.
      Reading the will, you are appointed joint executor and trustee but only for the purpose defined in Section 4. The estate is to be held by you both "for the benefit of my daughter, the said....absolutely."
      Only if that subclause fails, ie if she dies, would you then become eligible to receive the assets from the estate.

      My interpretation is that your Mum has left everything to her daughter as long as she survives. If not, everything goes to you.

        Thanks for clearing that up, so that's why I hadn't been notified of anything. At least I can just forget about it now, just have to accept that my mum did that, just wish I understood why. Thanks again.
