  • Opened up a can of worms now !!

    After 20 yrs o an old debt i managed to agree a settlement yesterday
    now i come home to find another demand for over £1,800 for a store card
    which is from 1998 .. Its from cabot again.. Its obviously sb so what should my next move be now ? Dont have any more funds to pay another one off ..

        It was as that debt was over 20 yrs old
        i had ignored all letters from many companys who kept selling the debt on
        then last week had a letter from my local cc that judgement has been issued
        and they were now seeking payment via attachment of earnings !!!
        Mortimer clarke who were claiming even said i made a payment on 6 th sep 2010
        abbsolute tosh that was ... I had bo choice as i could not get my employers involved as i work with cash .. I dis haggle with mortimer and got the sum down from £1,111.77 to £725.. Even after ccj was registered.
        hence why i dont want to ignore this latest letter !!!!

          That changes things somewhat, however, if you didn't receive the court papers and the debt was already SBd at the time the claim was issued, you could have applied for set aside. However, you may also have ignored the claim form... you should keep an eye out for anything coming from Northampton.

          On the AoE form, under item 10, there's an option to request a suspended order and make a monthly repayment offer instead. You need to give your reasons for requesting a suspended order, most commonly that such an order could affect your employment. They wouldn't want people to lose their job because that would render them unable to pay and there would be no earnings to attach, so they often agree. :thumb:

          Make sure the record is updated to reflect that the CCJ was satisfied.

          It's always best not to ignore creditors, even when the debts are SBd, as per my other post, proceedings can still be issued and they still have to be defended.

            To be honest not too botherd about my credit rating
            only got 5 more payments on my mortgage left
            and i have 12 credit cards and 3 store cards.
            So can get credit if i need too.

              Well i sent the sb letter to cabot , had an interesting reply saying i made a £10 payment on 6 th sept 2010 !!!! Dont think so... Strange as that was the same date i was told i made a payment to the account which i had a ccj ... They have said there is proof on route

                Good Luck I just wanted to point out that having credit cards with space on them does sometimes change as soon as their system gets up to speed and does the usual checks, you may suddenly get a letter saying that your £xxxxx credit limit is now £x !! They are b's and all check with one another so please just bear in mind that can happen, suddenly 'money' you may have thought you had access to disappears.

                  Yes that has happened allready had £3,000 on santander card now its gone down to £500 .....
