Re: moorcroft

The OP is saying that they are afraid the doors stepper is coming will come back " with a court warrant" but there has been no claim.
Ok let's see what we can do:
This is to go y signed for post to.
Mr Rodney Neil MCRoberts
Director Moorcroft Group
Moorcroft House
2 Spring Gardens
Stockport
SK1 4AA.

Date........................:

Re: Use Moorcrofts.

Re: Formal Complaint and Formal Notice.

I refer to recent correspondence from Moorcroft in regard to an alleged debt for £xxx.xx allegedly arising from an account with xxxxxxxxxxxxx, please note I do not acknowledge any debt to Moordroft or any company it may claim to represent.
I have now received two visits from a person purporting to represent Moorcroft please take note I do not discuss and financial matters with unknown individuals who call at my address without appointment and I have no desire to make such an appointment now or in the future.

The 2nd of these " visits" was made on Sunday 8th. March 2015 which if find most disquieting and unreasonable.

Moorcroft Will now take note of and comply with my wishes as to how contact may be made with me:

1. No further visits from any agent or representative of Moorcroft will be made and any such visitor will be " invited" to leave forthwith or be removed the police may be involved in such a removal.

2. Moorcroft Will only communicate in writing ( proof of posting will not be accepted as proof of receipt).

3. No telephone calls by Land Line or mobile phone will be accepted.

4. No e-mails of other electronic communication will be accepted.

Failure to comply will be treated as harassment ( please refer to Roberts - v - BOS Appeal Court 2014).

Yours etc.

signed for post and check delivery date.

( this is a tried and successful way of dealing with Moorcrofts morons).

Re: moorcroft

kaz1975, just for your own peace of mind have a read of this: http://www.stepchange.org/Debtinform...omevisits.aspx
Debt collector’s powers

If a debt collector does come to your home, you don’t have to open the door to them or speak to them if you don’t want to. A debt collector should always carry photo ID, and you should ask to see this before speaking to them.
A debt collector can’t:
• Enter your house or take any goods
• Discuss your account with anyone else in your house or with your neighbours
• Act in a threatening or intimidating way
• Refuse to leave if you ask them to

You can arrange to make a payment over the phone or by letter and you don’t have to open the door to debt collector if you'd prefer to pay another way.
Home visits are more likely from debt collectors who provide doorstep loans or forms of credit where you deal with a local agent or branch rather than a national collection department.
If a debt collector has treated you unfairly, you can make a complaint.
and this: http://www.stepchange.org/Debtinform...ourrights.aspx
Unfair debt collection

The FCA have set out rules on what they consider to be unfair debt collection practices. These include:
• Calling you at work without permission
• Discussing your debts with an employer or family member
• Refusing to deal with advice agencies like us
• Pressuring you to borrow more money to pay off debts
• Pretending to have legal powers they do not have
• Adding unreasonable charges
• Continuing to contact you when the debt is being disputed

If a creditor repeatedly fails to follow these rules, the FCA can issue a warning, impose a fine or withdraw their credit licence.
and this: http://www.adviceguide.org.uk/englan..._bailiff_e.htm
Is it a bailiff or debt collector?

Some creditors use debt collectors to get their money back. Debt collectors are not bailiffs, and don't have the same legal powers as bailiffs.
A debt collector should never pretend to be a bailiff to scare you into paying a debt. A real bailiff will have been through a certification process and will have been given special court authorisation to act.
Checking the difference between a bailiff and a debt collector

If you're not sure whether you're dealing with a bailiff or a debt collector, check the following:
• what kind of debt is the person chasing? If it doesn't appear on the list above, it's not a bailiff.
• have you received an enforcement notice? This is the official notice you must be given that bailiffs have been instructed to act against you. It must follow a set format. If you haven't received an enforcement notice, it's unlikely to be a bailiff.
• has an officer turned up at your door with no advance notice? Bailiffs must give you certain notices before they can visit your home, so if someone has turned up with no warning, it's probably not a bailiff.

Although debt collectors can chase you to pay what you owe, they're not allowed to take away your belongings.
If you're unhappy with the behaviour of a debt collector, you should complain to your original lender or contact your local authority's trading standards department, using the Citizens Advice consumer helpline.
You will get lots of help and advice on this from the knowledgeable Beagles, please try not to worry too much!

you are not acknowledging the debt to them (Moorcroft) not to the original creditor. I (personally) think Nem's letter is a good way of getting them off your back for a while at least

Re: moorcroft

I have just seen the post re the CCJ in whose favour was the CCJ awarded?
I guessing not Moorcrof as they have not mentioned it it seems?

Moorcroft may have no knowledge of the judgement and must if they wish to pursue
under the terms of the judgement apply to the court to have the judgement transferred
to Moorcroft.

In my opinion there must be a reason why the judgement has not been enforced.

Still a good idea to send the letter!!!
