    Take a look at these threads and see if you find anything that may be useful with regards to setting aside the judgment:


    Otherwise it's not easy to fight a final charging order being recorded, especially for judgments applied for from October 2012.

    You can put forward arguments and ask for conditions to be attached to a final charging order which make it harder for the creditor to force a sale, although orders for sale are very seldom granted for consumer credit debts. :thumb:

    Is the property in joint names?

        The CCJ was given in December 2014 and the charge on the house was done a week ago. I hope that clears up the time line. Thank you all for your help. Is it realistic to have the CCJ set aside, then the charge-given the large amount involved?

          I am seriously panicking, I just got another letter from Reston- with Charge Order details and the amount has now increased to £18k-what the hell! This is with their charges included, on my home. What am I supposed to do? Please help.

            You need to show that you have a viable defence to the claim because even if it gets set aside they can still reissue the claim. Do you think you'd have a suitable defence you could present to the court?

              Sorry for late response,was at work. What is a viable defence? I didn't get letters-due to not being at the property,is that enough? Is there anyway out of this?
