  • Notice of judgement arrears

    have a letter off Bryan carter .you have failed to to make repayments as ordered by county court judgement .this is from bank a/c from some time ago was o/d on the a/cut was paying it off steady but the bank was still adding charges on it .and I stoped paying when they went on and on with the charges on the a/c any help on this one ....?:juge::juge::juge::juge:

    Hi Welcome you cannot just stop paying a judgement!
    Was the bank allowed to a post judgement interest?
    What in the way of " charges" is being added?
    Please post up a redacted copy of the judgement order.
    Carter can and most certainly will take enforcement action
    very soon e,g. bailiffs, attachment of earnings.

      This bank thing has been going on for some time now .my thing with the bank was I was was willing to to pay off what I owed at the time the a/c not in being used .but the bank did not see the light maybe when I was paying in to the a/c to clear up the o/d lowell where asking for payment but now it seems Bryan carter have got a ccj on me to repay

        This has nothing to do with the bank?
        Lowell instructed Carter to issue a CC Claim?
        Did you receive a claim pack from the Northampton County Court Business Centre?
        Did You respond to it? i.e acknowledge the service of the claim?
        Lowell are the owners of the account.

        Do you have a defence to the original claim?

          It looks like they may have obtained default judgment against you. If a claim is not acknowledged within 14 days, the claimant can request default judgment. You can search to see if you have a CCJ here: http://www.trustonline.org.uk/search-yourself

          Once the account was sold to Lowell the bank you had the account with would have nothing to do with it. If you were willing to make payments, they should have gone to Lowell rather than the bank. You should have received a notice of assignment saying the debt had been sold.

          Have you moved ever since you stopped using the current account? Sounds like you may not have been receiving correspondence.

          In some cases, if judgment was obtained because you didn't receive the court papers, you may be able to apply for set aside, however, this would also require you to have a good defence against the claim. Any idea how much the alleged judgment was for?

          Your first step should be to find out whether there really is a CCJ against you. It's not that I don't trust BC but... :lie:
