  • anglian water filing defaults with CRA

    Can anybody help me please , I am at my whits end with anglian water.
    I moved house 2 years ago, until then I had always paid by direct debit.
    this was cancelled automatically , so i just recieved ordinary bills from anglian water.

    I was late paying one bill for £115, and to my understanding this appeared on the next bill , rolled forward, it was an ordinary blue bill.

    I paid the bill in full, The total I think was about £197.

    A few months later I applied for a buy to let mortgage (my business is buying and renovating cheap property to let) and was turned down.
    I was horrified as it was with an existing lender that I have 2 other properties mortgaged with.

    After getting my credit file I found that anglian water had put a default on my file.

    I have challenged them about this and have written numerous letters and made many phone calls.

    they still refuse to remove it.

    my question is how are they allowed to do this?

    According to all the information I can find a default is only registerd when there has been a serious breakdown etc and that I have broken a written agreement etc etc. I
    I have never signed any agreements, neither were any payment options discussed when we moved house. Anglian water have monthly quarterly 6 monthly and yearly billing.

    They say they sent me a notice of intention to file a default, but I have never recieved anything.

    It appears from my research on the FCA website that when sending such a notice, a letter explaining what a default is also has to be sent. They say they didnt send one.

    I have seen a thread on here challenging the legality of utility companies filing defaults, and it is quite clear to me that the procedures and policies of anglian water are clearly different from what is written on the FCA website, but how do I get them to remove it from my credit file?


    just for the record I have a squeaky clean credit file , no missed payments, no ccjs nothing, but mortgage companies just have this policy of any default, immediate rejection.

    This has effectively put me out of business. I just cannot buy anything now. I also have a very large credit card debt that was used to renovate a property with the intention of remortgaging and paying it off, but now I cant do that!

    I really feel that anglian water are so very wrong, each of the representives I spoke to wanted to remove it, but didnt have the authority. The head of customer services that I have written to doesnt answer my questions, just replies in a condescending way and says he wont remove it.

    Please has anybody got any advice?

    Hi welcome to LB,

    Dealing with customer (dis) service is as it always has been totally pointless, you need to write to CEO/COO of Anglian water and make a
    Formal Complaint setting out clearly why you believe the default is wrong and what Anglian need to do to answer your complaint.

    As this is not a regulated credit account but a service account the usual procedure is to send a "Demand for Payment" which will include the intention to place a default rather than a Default Notice as you would get on a credit account.

      You could try contacting the CEO:
      Mr Peter Simpson
      Head your letter "Formal Complaint" and request that he personally ensures everything is done to rectify the situation

        Thank you, I will try this.
        I still cannot understand how they are allowed to file a default when there has been no signed agreement. Filing this with CRAs with all the consequences it brings surely is a breech of my human rights!

        Dies anyone have any more suggestions as to how I should word the letter?

          If I was you, I'd explain almost as you did in your opening post ... but stress the fact that you paid when you received the bill, your DD stopping due to the house move, your good payment history etc...

            Thanks for the suggestion.
            Have just got a reply from Anglian waters peter simpson.
            Sadly its just a stock answer again. No answers to my questions, just a No.
            Where do I go from here?
            How can a late payment for a water bill be classed as a defaulted credit agreement?
            If they can do this surely they should follow the FCA guidelines , including sending a letter explaining what a default is. They have not done this and do not dispute it, when I ask why its just ignored.

            Who should I contact? Should I employ a solicitor? I cannot just left this drop.
            It is clearly all so very very werong that they are allowed to do this.

            Please any help whatsoever would be appreciated.

              Hi, I was wondering if you had any luck with sorting this because I am currently in the exact same position! Although not entirely sure whether my account is defaulted or delinquent... Anglian water are refusing to remove the big black mark on my credit. The rest of my credit is completely clean but this has taken me down to a very poor score!

                Good morning,
                Sadly I have got nowhere.
                They refuse to do anything.
                It is so wrong, they do not stick to FCA rules, saying they don't need to as it isn't a credit agreement, but then file a default that is viewed as a credit agreement default.

                I really wish someone had the finances to take them on.

                They have crippled me!!!!!!!
