  • U.S. Capital One Bank credit card "customer agreement" 2001

Hello, does anyone know where I can get hold of a 2001 U.S. "customer agreement" related to the visa card I had with Capital One Bank back then? Please advise.

The usual way would be to make a request to Cap one (CCA Request) under the CCA 1974, after 14 -15 years it is highly unlike there would be one available.
Someone may have archived on personally that they could redact and copy.

May I ask why you need this?

Thank you. If someone does have a copy of it please let me know. I have the 2002 one. The reason for the request stems from the fact that thousands of us here in Utah have been sued by Junk Debt Buyers "outside" the statute of frauds state of Utah,Section 25-5-4. The alleged use of the credit cards originated back in 2001 for many of us credit agreement consumers. Every credit agreement in Utah is statutorily "void" unless it is "within" the statute of frauds. It's the primary affirmative defense (SOL second) here in Utah when defending a debt collection action as a debtor. I'm in the throes of evidence gathering prior to filing a motion to vacate the judgment and prior to filing formal complaints against all the Junk Debt Buyers and their counsel here.

Is the "junk debt buyer an international one?
I have looked at couple of agreements from Capone (English Law) I'm sorry to say they will not be helpful.
Do you have a facility to request copies of documents as we have here A Subject Access Request made Under the UK Data Protection act 1998,.?
In England this requires the creditor to provide "personal data " that they hold.

I am not familiar with US State Laws relating to credit agreements, are these regulated by any form of consumer credit laws?
