  • Lowell Compensation Offer

    Hi currently disputing debt
    Lowell have chased since 2007, went dormant in 2009 and then raised again in October 2014.

    I contacted them in 2007 & 2008 in writing and via telephone , have all the letters and threats from2007 to present day.

    I have supplied in writing police incident number, 4 letters and numerous phone calls,at no stage did they suspend collection until the FOS wrote to them this year.

    After raising with the ombudsman for both Capital One and Lowell , Capital One confirmed I was not connected to the debt


    Lowell investigated and offered £100 in full and final settlement, I wrote back basically saying that for being harassed since 2007 this offer was not acceptable and I received another offer of £500.

    My questions are
    1) is this a fair offer considering they have chased me at various stages for over 7 years when I told them at the first letter stage verbally and in writing on at least four occasions

    2) Are Capital One culpable in this and do I have grounds for financial redress from them , for the stress caused as a result.

    3) I don't want to be unreasonable but they have chased me for years knowing the debt is in dispute and never ceased to do further checks

    I have a very good paper trail from 2007 to the present date

    My final reply was that I would accept £750 in full and final settlement, there responds is that £500 would not be increased!

    Any thoughts would be most welcome

    Hi,

    I think in this situation this most likely way you will achieve a level of redress after receiving Lowell's final offer would be to seek relief via the court system.

    Initially if Capital One had a debt linked to you, genuinely of as a result of fraud then you have a case if the debt was sold when Capone knew there was a dispute over your liability for the debt.
    Consequently Lowell would have bought the debt without being made aware that there was any dispute as debts are sold in portfolio lots with the absolute minimum of data.
    Once informed that the debt was not yours one would expect Lowell to refer back to Capone.

    Did FOS make any recommendation as to redress?

      No ,Lowell came back after investing the complaint

      I have not been back to FOS ,as I was dealing direct with
      Lowell, the basis of the FOS letter was to address my complaint and remove any record from my credit file

        Take all information to FOS it seems you have a good case and have all the data from the start to the present day regarding the dispute.
