I have had a letter from Restons Solicitors, Re:Cabot Financial(UK)Limited v.Yourself Halifax-Current Account.
I sent a letter asking for full proof that I do owe the money as in original signed documents as the debt is about 5 years ago.
Their reply today is,
This account relates to a Halifax current account overdraft and is therefore not covered under the provisions of the Consumer Credit Act 1974.
As you have not provided this office with you repayment proposals we have now been instructed to issue legal proceedings against you.
Are they correct about the Consumer Credit Act and can the do anything to me?
