    New member here. Glad to be part of the group.

    I have received a county court claim. I am currently completing forms N9A and N9B.

    The "Particulars of Claim" only states (in my eyes inadequately): "...claim for payment of invoice xxxxxx for professional services in relation to a proposed extension at the Defendants address..."

    1 When completing the "Defence" section (3) in the N9B, should I submit a full and comprehensive defence (including submission of all defence papers, statements, contracts etc.), or are the full defence papers submitted after the Directions / Allocation questionnaires are completed? How much detail is needed for this section of the form at this stage?

    2 Given the rather flimsy statement in the "Particulars of Claim" above, would a judge, in realty, reject / dismiss the case (given the Civil Procedure Rules?).

    1. No, you don't submit everything with the defence, that is much later down the line (what is the value in dispute?).

    You give a brief, bullet point list of why the invoice has not been paid including any allegations of poor service.

    2. A judge may give summary judgment based on that if undefended, if there is a hearing s/he will consider the evidence that is put before them - which as I said is put before the court at a future date.

      N9A is an admission form so you wouldn't want to complete that if you intend to defend the claim. :scared:

      Your first step should be to acknowledge service, which should give you an extra 14 days to submit a defence (a total of 33 from date of claim). That would be just form N009: http://hmctsformfinder.justice.gov.u...s/n009-eng.pdf

      Once you do that, you can take your time to work on the finer points of your defence. :thumb:

        stevemLS: You have confirmed what I thought. Thanks again. The in value in dispute is in the lower quarter of a four figure sum; (without giving too much away on an open forum).

        FlamingParrot: I'm admitting to a small, partial amount, hence, the completion of the N9A and N9B. The acknowledgement of service has been submitted as well, but thanks again for the heads up.

          You do realise a partial admission is likely to result in a CCJ for at least the amount you admit, don't you?

            The acknowledgement of service form has been sent stating "I intend to defend part of this claim." Out of interest, Is it too late to change now?
