If anybody can help with advice please pitch in ,was informed by bank 5 years ago that they didn't have an agreement ,yet cabots have launched ccj action.

give more details, do you have the letter concerned?

you need to cpr 31.4 asking for the details of the alledged claim as mentioned in the N1 court form, I will ask Ame to pop in

Hi,thanks I have the letter from the bank dated 2010 ,it all relates to an account opened in 1998 ,my post 10 para 3 of the above thread refers .

their letter actually states as they are unable to provide the original terms they will not seek enforcement action but I don't know if Cabot have something different ,even if they do I am in possession of this original signed document from the bank ,is that worth something ?

It's got to be worth something ... if you are sure this is what Cabot are trying to enforce, you have prior written proof that the bank have stated they would not seek enforcement action :tinysmile_twink_t2:. If that's the case then you could possibly let them know they are wrong :okay:

ask them for proof (if they have it), a bank said then they cannot find one etc, but if found could proceed up to 6 years England or 5 years Scotland that is if it is enforceable?

Thank you ,I'll compose something suitable ,if nothing else combined with my circumstances it may actually concentrate their minds and wonder if I'm worth the hassle .
I want them to withdraw the court claim ,it's spurious ,lazy and malicious.i've had it go through one bank and 3 dca's,anybody know if mortimers and cabots are the same company ? I'm inclined to think they are

One more question please ! Should I do this by letter or email and do I need to copy both the claimant and their solicitors ?
i have composed the letter may I please pm you both to see what you make of it ?
